Fintelekt Academy provides video-based learning content, discussion forums and online training programmes related to Anti-Money Laundering and associated subjects.

In these Membership Terms, Content means all the content available on the Site including all training videos, documents and forum content.

The copyright for all Content on the Site, as well as its compilation, overall design and look and feel belongs to Fintelekt Advisory Services Pvt. Ltd.

By providing Membership of the Site, Fintelekt gives you a revocable and non-exclusive privilege to use the Content for personal purposes. You are not permitted to download or redistribute any Content. However, you may use the knowledge gained through the Content (e.g. procedures, techniques, etc.) for any commercial or personal purpose.

This Contract and the Membership Terms apply to both – Free and Paid Memberships.

Free Membership refers to Memberships which are offered free of cost. Free Membership restricts access to certain areas of the site which can be accessed only by paying annual subscription fees.

Fintelekt may decide to terminate access offered under the Free Membership to any part of the site or its contents at any time without prior notice.

Paid Membership refers to Premium Memberships where subscription fees are paid by the user for a membership term of 12 months. Paid Members understand and agree to pay membership fees at the rate offered at the time of purchase for a period of 12 months to access the Fintelekt Academy site.

Cancellation of FREE MEMBERSHIP

You understand that you are able cancel your free membership at any time. Please email us on [email protected] to cancel.

You understand that by cancelling your membership you lose access to the site and all its content with immediate effect.

Cancellation of PAID MEMBERSHIP

You understand that you are able cancel your membership at any time. Please email us to cancel. However, Fintelekt is unable to provide any refund on membership fees paid either in part or on a pro rata basis.

If Membership is not renewed by paying annual recurring subscription fees, the Membership will be treated as cancelled and you will lose access to the site and all its content with immediate effect.

Memberships are only offered to persons over 18 years of age.

Membership of Fintelekt Academy is non-transferable. You must not share your Membership details with another user or allow any other person to access the site using your username and password.

You must keep your username and password confidential at all times. Unauthorised use or access of your membership should be reported to us as soon as possible.

Fintelekt will make every effort to make the site available at all times. However, we may need to suspend or interrupt access to the site for scheduled maintenance activity, technical or other reasons.

Fintelekt will make every effort to offer a wide range of content on the site for educational and learning needs on a regular basis. The content will be updated, modified or deleted from time to time at the discretion of Fintelekt. Fintelekt cannot guarantee that specific content will be available at all times on the site.

When accessing and using the Site and its services and Content, you are expected to comply with directions, instructions or guidelines suggested on the Site.

The membership offered to you is subject to a ‘fair use’ policy, which means that your use of the Site and the Content must be fair, genuine and reasonable in light of your genuine education and learning needs, and the time needed to genuinely engage with the Content. Fintelekt will use its reasonable discretion to decide whether a member has complied with the ‘fair use’ policy.

You are not permitted to use scripts or other means to download any Content from the Site.

You also agree not to:

a. use a false email address, impersonate another person, or misrepresent your affiliation with others;
b. insert advertising, branding or other promotional content into the Site or Content or its forums;
c. attempt to gain unauthorised access to computer systems or materials through the Site;
d. engage in automatic gathering of information from or through the Site (such as “spidering”, “screen scraping”, “database scraping” or harvesting of e-mail addresses);
e. attempt to interrupt or alter the Site’s operation in any way (for example through sending mass unsolicited messages, “flooding” servers, or introducing a virus, time bomb, trojan horse, worm, cancelbot or other computer routine);
f. use the Site or the Content in a way that violates applicable law, that violates third party intellectual property or other rights, or that is, fraudulent, obscene, offensive, or defamatory; or
g. Copy, distribute, transmit, modify or otherwise exploit the Content or any other data or code made available through the Site that do not conform to the usage Terms and Conditions in this Contract.

Fintelekt Academy offers Forums and Community areas on the Site that include Content contributed by Members such as comments, reviews and posts. These areas are also governed by these Membership Terms.

Fintelekt will try its best to, but is not obliged to, monitor all Content that is posted to Forums or Community areas of the site. Fintelekt cannot be held responsible or liable for Content posted by its Members. Fintelekt, however, reserves the right to edit, delete or refuse to post Content that may be deemed as objectionable or in violation of these Membership Terms or the applicable law.

You agree to not upload or post any materials that:

a. restrict or inhibit others’ use or enjoyment of the Site;
b. are false, misleading, fraudulent, unlawful, abusive, harassing, defamatory, obscene, vulgar, or offensive;
c. infringe others’ rights, including privacy or intellectual property rights;
d. disclose personal information about others, particularly sensitive information;
e. contain a virus, spyware, or other harmful component; or
f. contain commercial solicitation or ‘spam’ of any kind.

Fintelekt may disclose your personal information to its agents or vendors for the purposes of providing you with the services and Membership of Fintelekt Academy, including marketing activities.

Fintelekt may disclose any personal information as stipulated by any law, regulation or upon request by a governmental organisation.

Fintelekt may, at its discretion, restrict, suspend or terminate your Membership and access to the Site if you are considered in breach of these Membership Terms and Conditions or applicable law.

Fintelekt also reserves the right to refuse Membership to any person or organisation at its discretion for reasons such as (but not limited to) previous breaches of Membership terms of the Site or for non-payment of dues or fees.

Except as provided in an applicable Non-excludable Law, we are bound only by the express promises made in these Membership Terms and are not bound by implied terms.
Except as provided in an applicable Non-excludable Law:

1. we do not promise that the Content or your access to the Site will be uninterrupted or error-free, that any defects will be corrected, or that the Site or Content are free of viruses or any other harmful components; and
   b. we make no promises regarding your access to, or the results of your access to, the Site or Content in terms of correctness, accuracy, timeliness, completeness, reliability or otherwise.

Except as provided in an applicable Non-excludable Law, we and our affiliates are not liable for indirect, incidental, special or consequential damages, loss or revenue or loss of profits which result from any use of or access to, or any inability to use or access, the Site.

Fintelekt may change these Membership Terms from time to time, but will notify members before doing so.

Fintelekt Academy controls and operates the Site from their office in Pune, India. The laws of India govern these Membership Terms, and you and Fintelekt Academy submit to the jurisdiction of the courts in India.
